The Ministry of Labour & Employment is one of the oldest and important Ministries of the Government of India. The main responsibility of the Ministry is to protect and safeguard the interests of workers in general and those who constitute the poor, deprived and disadvantage sections of the society, in particular, with due regard to creating a healthy work environment for higher production and productivity and to develop and coordinate vocational skill training and employment services. Government’s attention is also focused on promotion of welfare and providing social security to the labour force both in organized and unorganized sectors, in tandem with the process of liberalization. These objectives are sought to be achieved through enactment and implementation of various labour laws, which regulate the terms and conditions of service and employment of workers. The State Governments are also competent to enact legislations, as labour is a subject in the concurrent list under the Constitution of India.

 

 

 

The Ministry of Labour & Employment which is one of the oldest and important Ministries of the Government of India, is continuously working on improving life and dignity of Labour force of country by protecting & safeguarding the interest of workers, promotion of welfare and providing social security to the Labour force both in Organized and Unorganized Sectors by enactment and implementation of various Labour Laws, which regulate the terms and conditions of service and employment of workers.

Accordingly, Ministry of Labour & Employment has developed eSHRAM portal for creating a National Database of Unorganized Workers (NDUW), which will be seeded with Aadhaar. It will have details of name, occupation, address,  educational qualification, skill types and family details etc. for optimum realization of their employability and extend the benefits of the social security schemes to them. It is the first-ever national database of unorganised workers including migrant workers, construction workers, gig and platform workers, etc.

Objectives of eSHRAM Portal
  • Creation of a centralized database of all unorganized workers (UWs) including Construction Workers, Migrant Workers, Gig and Platform workers, Street Vendors, Domestic Workers, Agriculture Workers, etc., to be seeded with Aadhaar.
  • To improve the implementation efficiency of the social security services for the unorganized workers.(ii) Integration of Social Security Schemes meant for UWs being administered by MoLE and subsequently those run by other ministries as well.

Who can register in eShram (NDUW) Portal?
  • Any individual satisfying following condition can register on the portal:
An unorganised worker (UW).
  • Age should be between 16-59 years.
  • Not a member of EPFO/ESIC or NPS (Govt. funded)
Who is Unorganised Worker?
  • Any worker who is a home based-worker, self-employed worker or a wage worker in the unorganised sector including a worker in the organised sector who is not a member of ESIC or EPFO or not a Govt. employee is called an Unorganised Worker.
What is required for registration?

Following is required to register on the portal:

  • Aadhar Number 
  • Mobile number linked with Aadhaar.

Frequently Asked Questions

Q1. Who are unorganized workers?

Any worker who is a home-based worker, self-employed worker or a wage worker working in the unorganized sector and not a member of ESIC or EPFO, is called an unorganized worker.

Q2. What is unorganized sector?

Unorganized sector comprises of establishment/ units which are engaged in the production/ sale of goods/ services and employs less than 10 workers. These units are not covered under ESIC & EPFO.

Q3. What is UAN?

Universal Account Number is a 12 digits number uniquely assigned to each unorganized worker after registration on eSHRAM portal. UAN number will be a permanent number i.e. once assigned, it will remain unchanged for the worker’s lifetime.

Q4. I am unable to connect to the helpdesk number – 14434. What should I do?

In case you are unable to contact short code helpdesk number 14434, you may also try the 10-digit number as provided by the CSC

Q5. Are there any income criteria?

There are no income criteria for registering on eSHRAM as unorganized worker. However, he/she should not be an income tax payee.

Q6. Are there any eligibility criteria to register in eSHRAM?

Any worker who is unorganized and aged between 16-59, is eligible to register on the eSHRAM portal.

Q7. What essential documents are required by the worker to register on eSHRAM?

Following is required by the worker to register on the eSHRAM portal–

    Aadhaar Number

    Note – If a worker does not have Aadhaar linked mobile number, he/ she can visit nearest CSC’s and register through Biometric authentication.


Q8. What is the benefit an unorganized worker will get when he/she registers on eSHRAM portal?

Central Government has developed eSHRAM portal which will be a centralized database of unorganized workers seeded with Aadhaar. After registering, he/she will get an Accidental Insurance cover of 2 Lacs under PMSBY. In future, all the social security benefits of unorganized workers will be delivered through this portal. In emergency and national pandemic like situations, this database may be utilized to provide necessary assistance to the eligible unorganized workers.

Q9. How unorganized worker can get register on eSHRAM portal?

An Unorganized worker may register himself/herself through visiting on eSHRAM portal or through assisted approach by visiting nearest CSC’s.

Q10. Is there any charge the worker must pay for the registration in eSHRAM?

Registration on eSHRAM portal is free. Workers are not required to pay any charges to any registering entity.

Q11.Will there be any deduction from worker’s bank account after registration?

No. Bank details are being captured to ensure hassle free delivery of benefits under social security schemes or any benefits by the Central/State government directly to the worker’s account.

Q12.Does the eSHRAM card have validity period?

This is a permanent number and valid for lifetime

Q13. Does the worker have to renew the UAN card?

There is no need to renew the eSHRAM card to the workers to regularly update their details, mobile number, current address etc. In order to keep his account active, he/she is required to update his account at least once in a year.

Q14. How workers can update their details in eSHRAM?

Workers can update their details through visiting on eSHRAM portal or through CSC’s

Q15. What are the details workers can update in eSHRAM?

Once registered, a worker may update his particular details such as mobile number, current address, occupation, educational qualification, skill types, family details etc. through visiting on eSHRAM portals or nearest CSC’s.

Q16. What is NCO?

It is National Classification of Occupation prepared on the basis of work and skill levels required to execute the work. It is an international practice and uniform across the country. It helps in comparing, classifying, sorting occupations and skill levels.

Q17. Select the matching occupation which worker is currently doing?

At the time of registration worker’s need to select occupation. It will be based on two level selection – At first level worker needs to select Sector (Agriculture, Automobiles, Construction, etc.), which is broad based category of activities. At second level worker is required to select his activity in the form of occupation which worker is currently doing. The activity which is source of his major income is primary activity/occupation. Any other activity which is a minor but significant source of income is called secondary occupation.

Q18. How occupation is different from skill?

A skill is a learned or natural ability to accomplish a particular task whereas an occupation is a person's usual or principal work or business, especially as a means of earning a living.

Q19. How my details will be used by the Labour ministry. ?

It is a centralized database seeded with Aadhaar. It will be used for delivery of social security benefits as implemented by Central & State Ministries. It will also ensure portability of the social security and welfare benefits to the migrant and construction workers at their working places. It may also be used for providing assistance to the eligible workers during any National crisis like COVID-19 in future.

Q20. What is PM Suraksha Bima Yojana?

Pradhan Mantri Suraksha Bima Yojana is an Accidental Insurance scheme of Government of India eligible to the people between 18- 70 years of age group. It provides benefit of Rs. 2 Lacs at the time of accidental death and permanent disability & Rs. 1 Lac in case of partial disability.

Q21.How PMSBY is associated with eSHRAM?

The registered workers under eSHRAM portal, will be enrolled under PMSBY and premium for the first year will be borne by the Ministry of Labour & Employment, Government of India

Q22 Is there any helpdesk I can contact to address my queries?

A dedicated National Help desk has been setup for any queries related to eSHRAM registration and grievances. Helpdesk Number is 14434 (or 10-digit number as provided by CSC)

Q23. What if after registration in eSHRAM the unorganized worker moves to organized sector?

He/she will only get the benefit defined for organized workers, as applicable to him/her.

Q24. What procedure needs to be followed in case of death of the worker?

Nominee or family member should file a claim along with relevant documents on the eSHRAM portal/ CSCs. They may also contact their concerned banks.

Q25. Whether I must give proof of my date of birth and income ?

At present there is no need to provide any proof of date of birth and income.

Q26. Where do I go to solve my grievance?

You may call on national helpdesk and register your grievance or register your grievance on eSHRAM Grievance portal (gms.eshram.gov.in)

Q27. Are there any educational qualifications prescribed for registering as an unorganized worker?

No. He/she should only be required to be employed in the gainful employment in the unorganized sector..

Q28. What are the documents that are to be submitted at the enrollment centre?

Worker are not required any document at the CSC’s. They are required to carry their Aadhaar number, Mobile number and bank account details along with IFSC code to register for registration along with Bank Account Details.

Q29. What action is required to be taken by the worker, after attaining the age of 60 years?

Worker do not need to take any action after attaining the age of 60. He/ she will continue to get benefits under eSHRAM project, he/she is entitled for.

Q30. Who will operate the help line/ grievance redressal mechanism?

National help desk/grievance redressal mechanism will be managed by Ministry of Labour & Employment and State call center’s/helpdesk will be managed by States.

Q31. Is the SMS language in regional language(s) of the State or in English/Hindi only?

Initially it will be in Hindi and English. Later, it will be provided in regional languages as well.

Q33. Can the worker update his/her photo on eSHRAM portal ?

During the registration, photo is pulled from Aadhaar services therefore provision to update photo is not available. However, if worker’s photo is updated in Aadhaar, same will be reflected on eSHRAM portal as well after Aadhaar authentication.

Q34. What is occupation ?

A person's usual or principal work or business, especially as a means of earning a living is called occupation.

Q35. What is primary occupation?

The activity which is source of his major income is primary activity/occupation.

Q36. What is secondary occupation?

Any other activity which is a minor but significant source of income is called secondary activity/ occupation.

Q37. I have lost my registered mobile number. How can I update my mobile number? or register any other mobile number on eSHRAM portal?

You can directly call the helpdesk number and after verifying your credentials, your mobile number on the eSHRAM portal will be updated. Alternatively, you can visit eSHRAM portal or nearest CSC/ SSK’s to update mobile number.

Q38. Are farmers eligible to register on eSHRAM portal?

Only agriculture labour’s and landless farmers are eligible for registration in the eSHRAM portal. Other farmers are not eligible.

Q39. I am 16 years old. Can I register in eSHRAM portal?

Yes, you are eligible provided you satisfy other registration criteria

Q40. I am 16 years old. Whether I am eligible for PMSBY if registered on eSHRAM?

No, the person should be between 18 – 59 years to be eligible for PMSBY through eSHRAM registration.

Social Security Welfare Schemes

 

Pradhan Mantri Shram Yogi Maan-Dhan (PM-SYM) Pension Yojana
  • Voluntary and contributory pension scheme.
  • Monthly contribution ranges from Rs.55 to Rs.200 depending upon the entry age of the beneficiary.
  •  50% monthly contribution is payable by the beneficiary and equal matching contribution is paid by the Central Government.

  • The manual scavenger and the dependents shall be provided, free of cost, skill training of their choice from the list of such trainings organized by the National Safai Karmacharis Finance and Development Corporation (NSKFDC) from time to time . 1 The Unorganised Workers Social Security Act, 2008

Around 88% of the workforce of the country is engaged in unorganised sector and they are not getting adequate social security benefits. Few welfare schemes are being implemented by the Central Government for specific groups/sub-groups of unorganised workers such as beedi workers, cine workers, building and construction workers etc. Government are implementing welfare programmes for certain categories of unorganised sector workers and non-government organisations also provide social security to certain categories of workers. Central Government to provide certain welfare schemes to all groups of the unorganised sector workers, has enacted the Unorganised Workers Social Security Act 2008. This act has now been sub synced in the code on social security which is a common welfare approach.

2 The Contract Labour (Regulation & Abolition) Act 1970

Contract labour refers to a person, who has been hired to work in a company through a contractor for a specific work and period. Companies hire contractors who, in turn, recruit these workmen for different jobs. In order to prevent the ill-treatment of workers in any establishment and to ensure a healthier working environment for them, the contract labour regulation and abolition act was introduced in 1970. This act aims in abolition of contract labour and regulation of their service conditions wherever necessary through setting up of advisory boards to advise Central and State Government in administering the legislation and registration of establishments and contractors. This act has been sub synced in the occupational safety health on working conditions.

3 The Inter-State Migrant Workmen (Regulation Of Employment And Conditions Of Service) Act 1979

This Act is applicable to establishments and contractor employing 5 or more inter state workmen during any day in last 12 months. The Act also provides for registration of the establishments employing Inter-State migrant workmen and license for the contractor. 4 The Minimum Wages Act 1948

The purpose of minimum wages is to protect workers against low pay. Minimum wages can also be one element of a policy to overcome poverty and reduce inequality, by promoting the right to equal remuneration for work of equal value.In order to improve the wage standards in industries and occupations in Asian countries, where the wages are low, a need of fixing the minimum wages were needed. This Act provides fixation by Provincial Governments of minimum wages for employments covered by schedule to be bill.

5 The Bonded Labour System (Abolition) Act, 1976

In some parts of the country a debtor or his descendants or dependants must work for the creditor without reasonable or no wages to fulfil his debt called Bonded Labour System. This act states that forced labour is an offence punishable in accordance with the law and an ordinance was promulgated by The Honourable President in 1975, where the bonded labour system was abolished and bonded labourers were freed and discharged from any obligation to do bonded work.

Labour Reforms:
To improve ease of compliance and ensure uniformity in labour laws, Government of India has recommended to consolidate the central labour laws into broader groups such as: (i) wages (ii) industrial relations, (iii) social security, (iv) safety, welfare and working conditions.
1 The Code on Social Security, 2020

The Code on Social Security act aims to amend and consolidate the laws relating to social security with the goal to extend social security to all employees and workers either in the organised or unorganised or any other sectors. This also extends the benefits of the social security schemes to the code to platform workers which are one of the leading employments generating sector.

2 The Code on Wages, 2019

This code seeks to regulate wage and bonus payments in all employments where any industry, trade, business, or manufacture is carried out. It will be applicable to all employees. For the workers working in the Central sectors, wages set by Central Government will be applicable and for the workers working in State Government sector, wages set by State Government will be applicable.

3 The Occupational Safety, Health and Working Conditions code, 2020.

The Occupational Safety, Health And Working Conditions Code, 2020 is a code to consolidate and amend the laws regulating the Occupational safety and health and working conditions of the persons employed in an establishment. The Act replaces 13 old central labour laws.

4 Industrial Relations Code, 2020

Industrial Relations Code, 2020 consolidates and amends the laws relating to Trade Unions, conditions of employment in industrial establishment or undertaking, investigation and settlement of industrial disputes. The bill was formulated according to the Report and Recommendations of the Second National Commission on Labour. The Industrial Relations Code Bill, 2020 proposed for amalgamating, simplifying and rationalising the relevant provisions of three Acts (i) Trade Unions Act, 1926, (ii) Industrial Employment (Standing Orders) Act, 1946, and (iii) Industrial Disputes Act, 1947

Ministry of Labour and Employment

The Ministry of Labour and Employment (MoLE) is the nodal agency and responsible for planning, policy formulation and implementation at the national level. It spearheads the initiative, while maintaining the national oversight over the activities and outcomes of the initiative.

Ministry of Electronics & Information Technology (MeitY)

An empowered committee called as “Project Steering Committee (PSC)” constituted under the Chairmanship of Secretary, (L&E) and Co-chaired by Secretary, MEITY along with members from different departments/ministries of central government would be responsible for project coordination between all stakeholders viz. EPFO, ESIC, NPCI, UIDAI, NIC and other ministries/departments already dealing with various schemes such as MGNREGA, PDS, State labour organisations etc. The PSC will further supervise the implementation of NDUW by considering and help in resolving inter departmental / ministerial issues.

National Informatics Centre (NIC)

NIC is the project executing agency for NDUW project and acting as technology partner to help MoLE for designing & development, setting up IT infrastructure on NIC cloud, project implementation of NDUW on turnkey basis. NIC is providing the overall ICT solution for this project.

State / UT Governments

The State / UT Governments would be the primary feeders and users of the NDUW platform. State / UT Governments will be responsible for implementation of NDUW in their respective State. Activities ranging from identification, registration, worker mobilization would be undertaken within the jurisdictional ambit of the State government. State / UT Governments would sensitize the UWs about the benefits of registration in NDUW.

Line Ministries/Departments of Central Govts

Ministries / Departments of the Central Government would be also the feeders of the NDUW portal for the Unorganised workers monitored by them. Bulk identification and registration of Unorganised workers would be undertaken within their jurisdictional in close coordination with the Ministry and NIC.

Workers Facilitation Centre and Field Operators

Workers Facilitation Centre working under State / UT Governments would also be the feeders of the NDUW portal to register the unorganised workers.

Unorganised Workers & Their Families

NDUW, as envisaged, would become a national platform to provide access to Unorganised Workers for getting social security schemes and benefit in future as per Code on Social Security, 2020.

UIDAI

UIDAI is the crucial partner of the project. It will enable MoLE to authenticate the UWs through Aadhaar and share key information with the NDUW Portal for completing Aadhaar based registration process and other relative help as needed from time to time.

NPCI

NPCI will provide API for validation of bank account of UWs and seeding of Aadhaar with bank accounts through NDUW Portal.

ESIC & EPFO

ESIC and EPFO will also be stakeholders of the portal and linked through UAN as the portal requires to check the membership of UWs with ESIC and EPFO which will be helpful in determining the status of worker as organised or unorganised. It would further identify the movement of workers from unorganised sector to organised sector and vice-versa.

CSC-SPV

CSC-SPV is an entity of the MeitY, is delivering various services under Digital India Mission across the country through its country wide network of over 3.50 lakhs centers. CSC-SPV is working as enrolment agency for the PM-SYM and NPS-Traders Schemes. Besides state Governments, CSC-SPV will also work as enrollment agency for the NDUW project.

Department of Posts Through Post Offices

There are about 1.55 lakh Post offices working under Department of Posts and they are already providing Aadhaar based services across India. They will also work as enrollment agency on the lines of CSC-SPV.

Private sector partners

Ministry will explore the possibility of onboarding of private sector partners such as employers of unorganised workers, Gig and Platform aggregators, milk unions, co-operatives for outreaching the registration of unorganised workers working with them. The open APIs shall also be published for extensive use of the private sectors. Data sharing if any, shall be done as per the data sharing policy of the Ministry or GoI.
